Each of the following terms has the following meaning in terms of these General Terms and Conditions:

• A visitor to Vitafresca.com is any person who accesses the website Vitafresca.com through electronic means of communication and social media and considers the product offer of VITA FRESCA;

• Buyer is a natural or legal person who orders and buys products offered by VITA FRESCA through the website Vitafresca.com.

For the Visitor/Buyer who uses the Vitafresca.com platform and enters into a business relationship with VITA FRESCA, the positive legal regulations in the Republic of North Macedonia in the field of electronic commerce, trade, consumer protection, personal data protection, as well as these General terms and conditions.

By accessing Vitafresca.com and ordering the products, you agree that you accept the General Terms and Conditions. VITA FRESC reserves the right to change these General Terms and Conditions at any time, and in such a case, VITA FRESCA will notify users of the change in an appropriate way through an announcement on Vitafresca.com.

Terms and conditions of purchase

Vitafresca.com is an online store that allows you to choose from more than 30 products available delivery. The process for purchasing and shipping products is explained below:

Make a selection of products

Make a selection of the desired products by adding them to the basket. You can specify the quantity by pressing the Add to Cart button (which adds one piece or the standard quantity of the product) and further increase it by pressing the Plus button on the same page or in the cart itself. The quantity can be reduced by pressing the Minus button on the same page or in the basket itself. You can find the products using the search engine in the top menu or by browsing through the categories. The buyer can choose one or more products from the VITA FRESCA offer. The buyer can cancel, add or modify the order at any time, before making the payment.
The product/s are reserved for delivery upon receipt of payment confirmation by the Buyer.

Order received

After payment, the order has been received and is being prepared for delivery. After the completion of the order, an e-mail will be sent to the e-mail address you specified, for confirmation of the order. The e-mail message contains the number and date of the order, type, quantity, individual and total price of the ordered products, method of payment, method and time of delivery and information about the buyer as well as the delivery address.

We deliver to your home

The prepared order will be delivered to the specified delivery address. You will receive an e-mail notification about the status of your order. The prices of all products on Vitafresca.com are expressed in Denars including VAT. VITA FRESCA will not be held responsible in case of erroneously expressed VAT on certain products that will not affect the final price of the product that the buyer will pay.

VITA FRESCA reserves the right to change prices, in accordance with the company’s policy, without notice to users. Price correction will not be made if the order is accepted. The buyer undertakes to pay the price that is offered at the time of execution of the order, regardless of the fact that the price may be changed in the meantime.

VITA FRESCA guarantees that every product published on the website Vitafresca.com has an appropriate declaration in accordance with legal regulations. Due to technical reasons, the product declaration published on Vitafresca.com may be different from the actual declaration carried by the product itself.

Products that are part of a certain action or are marked with special promotional prices, for which special promotional conditions apply and which are limited in quantity, for objective reasons there is a possibility that they will not be processed in the system, that is, orders with those items may be canceled. VITA FRESCA reserves the right to refuse any order in conditions where the buyer violates the rules of the planned action or promotion.
VITA FRESCA reserves the right to modify the duration of any promotion or product promotion at any time.

VITA FRESCA is not responsible for possible minor changes in relation to the products shown in the photos on the official website. The photos of the products displayed on the website Vitafresca.com are of an informative nature and may differ from the actual appearance of the products.

Each user bears full responsibility for their activities when using Vitafresca.com. Each purchaser also agrees to indemnify and hold harmless , its officers and employees from all claims for damages and expenses, including legal fees, that may arise from the unlawful use and infringement. of the General rules and conditions for using the Vitafresca.com platform by a buyer or other user.

Right of use

Violation of this obligation will be sanctioned according to the applicable regulations, whereby VITA FRESCA has the right to immediately terminate the business relationship with the buyer and limit/terminate the use of Vitafresca.com.

Method of payment

Payment for the products/services of VITA FRESCA purchased through Vitafresca.com is made through payment with a payment card; Electronic payment of ordered products is enabled through NLB Bank Skopje- MACEDONIA, whereby all VISA, MasterCard, Maestro or Diners payment cards are supported, as well as cards from domestic brands.

Payment is made electronically, in real time when the transaction occurs. When paying with a payment card, authorization is done automatically online through Asseco’s system. After successful authorization, the User receives a confirmation of successful/unsuccessful payment via e-mail and/or SMS.

Data related to the customer’s payment card or bank account is sent directly to the bank via an encrypted connection. VITA FRESCA does not collect the aforementioned data and has no access to payment card or bank account information.
VITA FRESCA under no circumstances assumes responsibility for damage due to an unauthorized transaction, ie unauthorized use of the buyer’s personal data during the realization of the electronic payment.

VITA FRESCA fully disclaims any responsibility for the damage that may be caused to the buyer and/or to third parties if it occurs as a result of inappropriate and unauthorized use of the payment card, i.e. if for any reason it is misused or used without the knowledge and/or consent of the owner or if stolen. In the mentioned cases, VITA FRESCA has no obligation to return the paid funds.

VITA FRESCA will not bear responsibility for any caused damage that could occur as a result of a technical error that occurred before/during/after the moment of using the electronic services, and over which VITA FRESCA had no insight and control.

Receipt of products

Every buyer is obliged, when taking the product, to check it for possible physical damage during transport, and if it is about several products, to check whether any product is missing or of a different quality/quantity compared to the ordered one. If the product is delivered damaged, or a certain product is missing from the order, the buyer should inform VITA FRESCA through one of the channels for contacting the Customer Service within 12 hours of receiving the products. In this case, the buyer must provide VITA FRESCA with indisputable evidence regarding the defects, that is, physical damage to the products and enable the return of the products in the same condition in which they were received.

As part of its commitment to protecting consumer rights, as well as promoting trust in online commerce, if VITA FRESCA determines that the complaint is founded, i.e. justified, VITA FRESCA guarantees the following rights to buyers:

• Replacement of products of suitable quality, whereby the delivery costs and any other costs for the return will be borne by VITA FRESCA. If VITA FRESCA does not have a suitable product (a product that will meet the buyer’s needs), the buyer has the right to request a refund of the paid amount; or

• Use of a value coupon – a voucher in an amount that will be determined by VITA FRESCA and which will be proportional to the determined deficiencies, and which the buyer will have the right to use for the purchase of products available at Vitafresca.com within 30 days; or

• To be refunded the amount paid for the products that contained a certain deficiency, that is, damage. The funds will be returned to the same bank account that was used for payment.

For all other products, the buyer has the right to return a purchased product within 15 days from the date of delivery, provided that the product being returned is in the same form and content in which it was delivered, unpacked, unused and undamaged, if the appearance is preserved of the product, the period of use, useful properties, seals, factory labels, as well as the accompanying documentation that was given to the buyer together with the product during delivery. Delivery costs and any other replacement costs may be accepted by VITA FRESCA, but may be requested and borne by the buyer.

The right to return products can be exercised by submitting a Return Request. Refund request.

If at the time of submission of the request by the buyer, VITA FRESCA does not have a suitable product (a product that will meet the needs of the buyer), the buyer has the right to request a refund of the paid amount.
